My Family Tree App is operated by Nimbus Digital Ltd. ("we", "us", "our"), a company registered in England and Wales under company number 07967404, with registered office at 11/12 Hallmark Trading Centre, Fourth Way, Wembley, Middlesex, HA9 0LB, UNited Kingdom.
By creating an account you agree to these Terms & Conditions and to our Privacy Policy. If you do not agree, do not register or use the service.
1. The Service
We provide a private, invite-based family tree platform ("the Service") allowing registered users to create "trees," invite others to collaborate at various permission levels, and store genealogical records, photographs, and documents relating to their family.
2. Eligibility & Accounts
- You must be at least 16 years old to create an account (aligned with the UK GDPR's default digital consent age; we may set a higher age for specific features at our discretion).
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You must provide accurate registration information and keep it up to date.
- We may suspend or terminate accounts that breach these Terms, in line with Section 8.
3. Trees, Roles & Content
- A tree's Owner controls membership, permissions, and content within that tree. Other members hold the role the Owner (or another Owner/Editor acting with the Owner's authority) assigns them: Editor, Contributor, or Viewer.
- You are responsible for the content you add. This includes ensuring you have the right to share any personal data, photographs, or documents relating to other people — living or deceased — that you upload. Where you add personal data about a living third party (for example, a living relative's date of birth), you are the data controller for that data in relation to your use of the Service; we act as a data processor on your instructions in that respect. See our Privacy Policy for what this means in practice.
- You must not use the Service to upload content that is unlawful, defamatory, harassing, or that infringes another person's intellectual property or privacy rights.
- We may remove content or suspend access where we reasonably believe this section has been breached.
4. Living-Person Privacy
The Service applies privacy restrictions to records marked as belonging to a living person, limiting visibility of dates, notes, and events to Owners and Editors of that tree (see our Help Centre for full detail). This is a feature of the Service, not a guarantee that all sensitive information is automatically identified — you remain responsible for marking records accurately and for exercising judgement about what you upload in the first place.
5. Sharing & Invites
- Owners may invite others to a tree by email, and may generate view-only share links. Anyone with a valid share link can view the tree subject to the same living-person privacy rules.
- You are responsible for controlling who you invite or share links with. We are not responsible for consequences arising from a share link or invite being forwarded or accessed by someone you did not intend.
6. Subscriptions & Payment
- The Service is offered on a free tier and one or more paid subscription tiers, as described at https://my-family-tree.app/#pricing.
- Paid subscriptions are billed in advance for the billing period selected (monthly or annual, as applicable) via our payment processor, Stripe.
- No refunds for partial periods. If you cancel a paid subscription, or if your account is suspended or terminated for breach of these Terms, you will not receive a refund for the unused portion of your current billing period. Your subscription will remain active, and paid-tier features accessible, until the end of the period you have already paid for; it will then not renew.
- We may change subscription pricing on notice; continued use after a price change takes effect constitutes acceptance, but you may cancel before the change applies.
- We reserve the right to change, add to, or discontinue features of any tier, including the free tier, on reasonable notice.
7. Acceptable Use
You must not:
- Attempt to access another user's tree without authorisation;
- Use automated means to scrape, extract, or bulk-download content from the Service beyond the GEDCOM export tools we provide for your own tree(s);
- Upload malicious code, or attempt to interfere with the Service's operation or security;
- Use the Service to build a competing product from data you do not own.
8. Suspension & Termination
We may suspend or terminate your account, with or without notice, where:
- You breach these Terms;
- We reasonably suspect fraudulent, abusive, or unlawful use;
- Required to do so by law.
You may close your account at any time from your account settings. On closure, we will delete or anonymise your personal data in line with our Privacy Policy and our data retention schedule, save where we are required or permitted to retain it (e.g. billing records, backups per our retention policy).
9. Intellectual Property
- You retain ownership of content you upload (photographs, documents, notes, etc.). By uploading content, you grant us a limited, non-exclusive licence to host, store, back up, process, and display that content solely for the purpose of operating the Service for you and those you've given access to it.
- The Service's software, design, branding, and underlying technology are owned by us or our licensors and are not covered by the licence above.
10. Disclaimers
- The Service is provided "as is." While we take reasonable steps to maintain availability and to back up data (see our backup policy, available on request), we do not guarantee uninterrupted or error-free operation, and we are not responsible for loss of data arising from causes outside our reasonable control.
- Genealogical relationship calculations and GEDCOM import/export are provided as tools to assist your research; we do not warrant the historical or factual accuracy of any content, whether generated by these tools or entered by users.
11. Limitation of Liability
Subject to applicable law, our total liability to you arising out of or in connection with these Terms or the Service, whether in contract, tort, or otherwise, shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) £[AMOUNT]. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under English law, including liability for death or personal injury caused by negligence, or for fraud.
12. Indemnity
You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal costs) arising from your breach of these Terms or your misuse of the Service, including content you upload without the right to do so.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified in-app and you will be asked to review and accept them before continuing to use the Service. The "Last updated" date and version above reflect the current version.
14. Governing Law
These Terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
